  1. Instructions on how to enter and receive the Continuity of Service Offer from Uniting (“Offer”) forms part of these Terms and Conditions. Participation in the Offer is deemed acceptance of these Terms and Conditions.
  2. The Offer commences at 9.00am on Friday, 1 December 2017 and ends at 5.00pm 30 June 2018 (“Offer Period”). Uniting may extend or terminate the Offer Period in its sole discretion.
  3. This Offer is open only to individuals who have been assessed under the Aged Care Act as eligible to receive Residential Care Services and are currently residing in a retirement village in New South Wales or the Australian Capital Territory that is owned or operated by Uniting or are currently receiving home and community care services from Uniting (“Eligible Clients”).
  4. During the Offer Period, Eligible Clients who are assessed by the Australian Government as having the means to pay the Advertised Accommodation Price for any Accommodation in any Residential Care Service operated by Uniting, have the opportunity to obtain a 20% discount on the Advertised Accommodation Price.
  5. Individuals who are assessed by the Australian Government as low means, will be advised by the Department of Human Services of the applicable Accommodation Contribution (if any) once formal confirmation of their means is received.  In this case the Accommodation Contribution will apply as notified but will be capped at no more than the equivalent value of the 20% of the Advertised Accommodation Price.
  6. The Offer applies to Accommodation Payments only and does not apply to any other daily payments payable for Residential Care including payments of daily fees for care services or fees for additional services.
  7. To claim the Offer, by the end of the Offer Period, Eligible Clients must commence living in and receiving Residential Care in a Residential Care Service operated by Uniting or must have commenced pre-entry leave at the Residential Care Service before starting to live at the Residential Care Service, as permitted under the Aged Care Act.
  8. The Offer is subject to the availability of Accommodation at any Uniting Residential Care Service during the Offer Period and Uniting cannot guarantee that Accommodation will be available to Eligible Clients at the time and place of their choosing.
  9. Eligible Clients are not entitled in any circumstances to priority access (including as defined in the Retirement Villages Act 1999 (NSW) and the Retirement Villages Act 2012 (ACT)) to Accommodation.
  10. Uniting reserves the right, at any time, to verify the validity of a person’s application and their status as an Eligible Client and to disqualify any person who submits an application that is not in accordance with these Terms and Conditions, or who makes a false statement or who tampers with the application process. Errors and omissions will be accepted at the Uniting’s discretion. Failure by Uniting to enforce any of its rights at any stage does not constitute a waiver of those rights.
  11. If this Offer is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of Uniting, Uniting reserves the right, in its sole discretion, to the fullest extent permitted by law to disqualify any Eligible Client or to modify, suspend, terminate or cancel the Offer, as appropriate.
  12. Any cost associated with entering this Offer is the applicant’s responsibility. Applicants are encouraged to seek their own independent financial advice with respect to the impact that participating in the Offer may have for their own financial circumstances.
  13. Uniting (including its officers, employees and agents) is not liable in any circumstances for any loss or damage (including loss of opportunity) however arising, whether direct, indirect, special or consequential, arising out of or in connection with the Offer.
  14. Nothing in these Terms and Conditions is intended to exclude, restrict or modify the operation of the:
    1. Aged Care Act (including any person’s rights under the Aged Care Act);
    2. Retirement Villages Act 1999 (NSW);
    3. Retirement Villages Act 2012 (ACT); or
    4. Any consumer rights under the Competition and Consumer Act 2010 (Cth) or any other legislation which may not be excluded, restricted or modified by agreement.
  15. Privacy – For the purposes of this Offer Uniting collects your personal information. For further information about the way Uniting handles your personal information please see our Privacy Policy at www.uniting.org/privacy-policy. Our privacy policy also sets out information about how you may access your personal information, seek correction of your personal information or make a complaint about a privacy matter.
  16. Definitions used in this Offer
    1. Accommodation means a bed or room within a Residential Care Service operated by Uniting.
    2. Advertised Accommodation Price means the price advertised by Uniting for specific Accommodation in accordance with the Aged Care Act.
    3. Accommodation Payment has the meaning given in the Aged Care Act and is payable as either a refundable lump sum (known as a Refundable Accommodation Payment or RAD) or daily payment (known as a Daily Accommodation Payment or DAP).
    4. Aged Care Act means the Aged Care Act 1997 (Cth) as amended from time to time and includes all regulations, Principles and Determinations made under it.
    5. Residential Care has the meaning given in the Aged Care Act.
    6. Residential Care Service has the meaning given in the Aged Care Act.
    7. Uniting means Uniting NSW. ACT an institution of the Uniting Church of Australia.

  7. The Promoter shall not be liable for any costs, loss or damage whatsoever which is incurred or sustained as a result of participation in the Promotion or use of the Prizes.
  8. The Promoter may, at its sole discretion, display Entries but will, at the request of the Entrant’s parent, guardian or carer, remove any identifying information of the Entrant.
  9. The winner and runner up will be notified by phone and/or email. If, for any reason, the winners cannot be contacted or do not claim the prize within two weeks, a second judgment will be conducted by the Promoter.
  10. The decision of the judges is final, and no correspondence will be entered into.

  1. Information on how to enter, mechanics of entry and prizes form part of these Conditions of Entry. Entry into the Promotion is deemed acceptance of these Conditions of Entry. Entry is via Instagram only.
  2. The Promoter isThe Uniting Church in Australia Property Trust (NSW) for Uniting (NSW.ACT) (ABN 78 722 539 923), Level 4, 222 Pitt Street, Sydney 2000 (‘Promoter’).
  3. Entry is limited to residents of Australia aged 18 years and above (Entrants). Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family is defined as any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
  4. Promotion commences at 10:00am (AEST) on Sunday 18 February 2018 and ends at 5:00pm (AEST) on Monday 26 February 2018 (“Promotional Period”).
  5. To enter, Entrants must visit the Uniting Stand at the Sydney Gay and Lesbian Mardi Gras Fair Day event during the Promotion Period and take a photo/selfie of themselves at the Uniting stand located in Zone C. Then, Entrants must tell us in 25 words or less, ‘What you would tell your younger self’ and upload the image/photo with the hashtag #weareuniting, on their own Instagram account, and provide all requested mandatory details. The Entrant must also agree to the competition Terms and Conditions. From Monday 19 February entrants can enter as per the above stipulations but do not need to visit the Uniting Stand at the Sydney Gay and Lesbian Mardi Gras.
  6. Once an Entrant has submitted their completed entry they will be treated as having submitted one (1) entry in the Promotion. Multiple entries are permitted by an Entrant; however, only one entry per day will be eligible. Each entry must be the original work of the entrant and not infringe on any Copyright or Privacy laws.
  7. Entries will be deemed accepted at the time of receipt by the Promoter and not at the time of transmission. Entries received will be considered final by the Promoter. Incomplete, inaccurate, erroneous, ineligible or incomprehensible entries will be deemed invalid at the sole discretion of the Promoter. The Promoter accepts no responsibility for late, lost or misdirected entries. Entrants are responsible for all costs and/or expenses that are incurred as a result of all activities associated with the Promotion.
  8. Any entry that contains content that the Promoter, in its sole discretion, considers to be offensive or inappropriate in any way or that the Promoter considers, in its sole discretion, to infringe any intellectual property rights, privacy rights or other rights of any person, corporation or entity, or that pose a risk to the health, safety and/or wellbeing of any person, will be considered ineligible. The decision to accept or reject an entry is at the Promoter’s sole discretion and no correspondence will be entered into.

    In conjunction with condition 28 of these Terms & Conditions, as a condition entering the Promotion, the Entrant irrevocably grants to the Promoter a non-exclusive, royalty-free, sub-licensable, and transferable licence to use, reproduce, and/or display and use your entry, together with your name or State or Territory, on the Promoter’s Facebook page https://www.facebook.com/weareuniting/ for promotional, marketing or publicity purposes and other lawful promotional purposes whether in respect of the Promotion or in any other way that the Promoter sees fit.

  1. The Judging will be held at 10:00am (AEST) on Tuesday 27 February 2018, at Uniting, Level 4, 222 Pitt Street, Sydney 2000.

    The entry, determined at the sole discretion of the Judging Panel (consisting of LGBTI figureheads appointed by the Promoter) as the most creative/valuable piece of advice. The criteria is: 1) the answer is 25 words or less, 2) the “advice” given to your younger self (the answer) would be helpful/beneficial to your current self and 3) the answer is humorous, wise, helpful, unique or creative and/or apt submitted will be the winner. The entrant who aligns with the criteria and/or apt entry will receive the Prize.

    This is a game of skill and chance plays no part in determining the winner. Each entry will be individually judged on content, creative merit and aptness. The judge’s decision will be final and no correspondence will be entered into.

    The winner will be notified in writing immediately via Instagram private message after the Judging, and will be announced on the Uniting Instagram Page at @weareuniting and on the Uniting website at www.uniting.org on Wednesday 28 February 2018

    The Prize winner will receive two (2) single General Admission Tickets to the Sydney Gay and Lesbian Mardi Gras After Party on 3 March  at 10pm at Playbill Venues – Fox Studios, 1 Driver Ave., Moore Park, NSW 2021

    The maximum retail value of the Prize is $1,000. Total prize pool value is $1,000.

  2. If the prize is unclaimed or forfeited by 5.00pm (AEST) on 1 March 2018, the prize will be awarded to the entrant with the next most creative & apt entry in the Judging, as determined by the judging panel under the same terms and conditions, at 10.00am (AEST) on 2 March 2018 at the same location as the original judging. The new winner, if any, will be notified in writing via Instagram private message immediately.
  3. The Prize is not transferable or exchangeable and cannot be taken as cash. The Prize must be taken as offered and cannot be varied. If for any reason the winner is unable to accept the prize as stated, the winner will forfeit the prize and no compensation will be given in lieu. The Promoter accepts no responsibility for any tax implications that may arise from the Prize winnings. Values are accurate as of 13 February 2018, and the Promoter is not responsible for any variation in values. Prize values are in Australian dollars and recommended retail price includes GST where applicable. Prize supplier conditions apply.
  4. The Prize will be purchased by the Promoter and will be subject to the Conditions of the participating prize supplier.
  5. The winner must be a minimum of 18 years of age. Prize Terms & Conditions apply.
  6. The Prize does not include travel to or from the Prize location, accommodation or any other expenses associated with accepting a prize.
  7. The Prize is subject to availability.
  8. Any changes or costs incurred once the tickets have been issued will be the sole responsibility of the winner.
  9. If the Prize, or any portion of the Prize, cannot be provided for any reason, the Promoter reserves the right to provide an alternative Prize to the same value and nature, subject to approval by the relevant state authorities.
  10. Entrants must enter the Promotion in their own name. Entrants who provide incorrect, misleading or fraudulent information are ineligible to participate in the promotion and all entries of an Entrant who is deemed by the Promoter to have provided incorrect, misleading or fraudulent information may, at the sole discretion of the Promoter, be deemed invalid. The Promoter reserves the right to request the Entrant produce (within the requested time) appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm the Entrant’s identity, age, residential address, eligibility to enter and claim a Prize, and any information submitted by the Entrant in entering the promotion, before issuing a Prize. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or an Entrant or entry has not been verified or validated to the Promoter’s satisfaction then all the entries of that Entrant will be ineligible and deemed invalid.
  11. It is a condition of accepting the Prize that the winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
  12. The Prize will only be awarded following any winner validation and verification that the Promoter requires in its sole discretion.
  13. The use of any automated entry software or any mechanical, electronic or other means that allows an Entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that Entrant invalid.
  14. The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect or consequential loss), damage, personal injury or death which is suffered or sustained (including but not limited to that arising from any person's negligence) in connection with taking any Prize or using any Prize, except any liability that cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
  15. The Promoter and its associated agencies and companies are not responsible for any problems, delays or technical malfunction of any telephone or network or lines, servers or providers, fax equipment, computer equipment, software, technical problems or traffic congestion on a network or a mobile network or any combination thereof, or any other technical failures including any damage to Entrant's or any other person's fax equipment, mobile handset, computer or peripherals related to, or resulting from, participation in this promotion or the downloading of any materials related to this promotion.
    The Promoter will communicate and advertise this competition on the Uniting stand at Fair Day and on their social channel.  The competition however, is in no way sponsored, endorsed or administered by, or associated with, Facebook or Instagram.  Entrants are providing their information to the Promoter and not to Facebook or Instagram.  Each entrant completely releases Facebook and Instagram from any and all liability. Entrants acknowledge that all content posted on Facebook must be in accordance with Facebook terms (http://www.facebook.com/terms.php) and Instagram terms (https://help.instagram.com/179379842258600)
  16. The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter including but without limitation technical malfunctions or failures.
  17. If for any reason the Promotion is not capable of running as planned for any reason beyond the reasonable control of the Promoter including because of war, terrorism, state of emergency or disaster (including natural disaster), infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or any which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the promotion and/or if necessary to provide an alternative prize or prizes to the same value as the original Prize.
  18. The Promoter reserves the right to verify the validity of any and all entries and reserves the right to disqualify any Entrant for: (a) tampering with the entry process; (b) for submitting an entry which is not in accordance with these Conditions of Entry; or (c) if the Entrant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
  19. As a condition of entering the Promotion, an Entrant consents to, in the event they are a winner, the Promoter using the Entrant’s image and caption, name, likeness, image, voice (including photograph, film and/or recording of the same), and/or entry in any media for an unlimited period of time and worldwide without further notification, remuneration or compensation for the purpose of promoting, publicising or marketing the promotion (including any outcome), and/or promoting any products or services manufactured, distributed and/or supplied by the Promoter and their associated or affiliated companies.  The Entrant agrees that, in the event they are a winner, the Entrant will participate in all reasonable promoted activities in relation to the Promotion as requested by the Promoter and its agents.

    The Promoter may at their discretion choose to publish entries during and/or after the Promotion Period.

  20. An entry and any copyright subsisting in an entry irrevocably becomes, at time of entry, the property of the Promoter and may be used by the Promoter at any time.  The Promoter collects personal information about an Entrant to include the Entrant in the promotion and, where appropriate, award Prizes. If the personal information requested is not provided, the Entrant cannot participate in the promotion and is deemed ineligible. An Entrant can gain access to, update or correct any personal information held by the Promoter by contacting the Promoter’s Privacy Officer at the address in condition 3 of these Terms & Conditions. All personal information will be stored at the office of the Promoter. A copy of the Promoter’s Privacy Policy in relation to the treatment of personal information collected may be obtained by contacting the Promoter.
